Chinmark Group, the sponsors of FinAfrika Investment Limited, the company behind the defrauding of over 4000 investors of over N10 billion has filed for the voluntary liquidation of its assets with the Corporate Affairs Commission.
This followed the publication of the decision in newspapers as mandated by relevant laws.
The doomed company founded by Marksman Ijomah also appointed Lead-Path Law Partners to oversee the orderly repayment of investors’ deposits and wind down the company upon repayment of all liabilities to investors.
But a lawyer, Azubuike Ihemeje said Chinmark is a full-blown criminal venture and not a failed business venture that is facing challenges.
“It was a vehicle for criminality from the onset. Chinmark committed crimes by violating the laws against crowdfunding.
“They(chinmark & cohorts) also committed Cyber Crimes by using Facebook in furtherance of their criminalities. Everything chinmark has acquired is deemed proceeds of crime.
“In our laws, whenever proceeds of crime are liquidated via a Civil suit, they are usually confiscated by the federal government, and not the victims. The only surely available means that guarantee the slightest remedy is the criminal justice system.
“Depending on how you pursue it, a criminal case instituted against a scammer, guarantees much for the Victims, via; Restitution, Plea Bargain and more, under our latest Administration Of Criminal Justice Laws.
“But you see this civil suit for liquidation, it’s all pure antics by the criminals to escape justice.
“For sure, a criminal will hardly disclose details of all his properties in a civil case which he initiated. They’ll suppress facts and the truth of relevant details of his entire exposures. As for criminal cases, forensic interrogations and detailed investigation will unveil everything by force”.
